Ex-Lexington aide goes on trial in Fulton County

JOHNSTOWN - Opening statements are scheduled at 9 a.m. today in the Fulton County Court trial of former Lexington Center aide Mark A. Stearns, who is accused of taking photos of nude male Lexington clients. A jury was selected Monday before Fulton County Judge Richard C. Giardino. District Attorney Louise K. Sira is prosecuting. Defense attorney Randall E. Kehoe of Albany has predicted an acquittal. Stearns, 50, of Iris Lane, Fultonville is charged with unlawful surveillance and misdemeanor endangering. Authorities said the photos were discovered by Stearns' estranged wife after she took Stearns' laptop computer when the couple split up. The photos of two Lexington clients were found in a computer file, Sira has said. Stearns was arrested last fall after working for Lexington for 10 years. He was fired after his arrest.
